Case Diary has been produced by the State.

I have taken into account the period of detention of the present petitioner and the nature of the materials appearing against him. Having considered the period of detention of 70 days, I am of the view that further detention of the petitioner is unwarranted in the facts and circumstances of the case.

However, the merits of the case call for certain stringent conditions. Accordingly, petitioner/appellant namely, Haradhan Halder shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty

Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Judge, Special Court under the SC & ST (POA) Act, Barasat. If on bail, the appellant shall stay outside the jurisdiction of Gaighata Police Station till the same is modified by the learned Special Court.

Petitioner will attend the local police station once in a week where he would be residing and furnish his place of residence to the learned Special Court and the investigating officer of the case prior to his release on bail.

With the aforesaid observations CRA (SB) 34 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
