The instant appeal has been filed against an order dated 24.08.1992 passed by the learned 3rd Judicial Magistrate, Barrackpur in complaint case No. 363 of 1990 under Section 630 of the Companies Act whereby the present opposite party i.e. Kalyan Kumar Dasgupta was acquitted under Section 256 of the Code of Criminal Procedure.

From the record it appears that the learned Additional Chief Judicial Magistrate, Barrackpore, North 24 Parganas vide Memo No. 22226 Cr (A) 2227 Cr. (A) dated 20.09 2018 stated that the appellant i.e. Purnendu Chandra Sen has expired. Let the said report be kept on record.
