Learned advocate appearing for the petitioner has prayed for expeditious disposal of an application under Section 21 of the Protection of Women from Domestic Violence Act which has been filed in connection with A.C. Case No. 2028 of 2021 and is pending before the learned Judicial Magistrate, 2nd Court, Alipore. Learned advocate has referred to the prayer which has been advanced for temporary custody of the minor girl child and also draws the attention of the Court to the fact that the application was filed on 22.07.2022 and till date, after one and a half years the said application has not been disposed of. It has been brought to the notice of this Court that next date is fixed on 27.02.2024. Having considered that the petition under Section 21 of the Protection of Women from Domestic Violence Act is pending for more than one and a half years, the learned Judicial Magistrate, 2nd Court, Alipore is directed to dispose of the same on 27.02.2024 or within a fortnight thereafter. Learned Magistrate will not stretch the time limit fixed by this Court for disposal of the said application.

With the aforesaid observations, the revisional application being CRR 637 of 2024 is disposed of.

Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
