Ct. 19 sg Mr. Prabir Maji ...for the petitioner Mr. Chandi Charan De, Ld. AGP Ms. Chandana Ghosh ...for the State Affidavit of service filed in Court is taken on record. The petitioner claims to be the owner of several plots of land within Mouza Kaikhali, under Police Station Kultali, in the District of South 24 Parganas. The petitioner alleges that the Panchayat authorities are taking steps to construct a concrete road over the plot of land of the petitioner without initiating any proceeding for acquisition or requisition. The petitioner submitted a representation before various authorities including the Block Development Officer, Jamtala, dated 19th January, 2026.

The learned Advocate for the petitioner submits that in spite of receipt of such representation, no steps have taken by the respondent authority to communicate their decision on the representation submitted by the petitioner till date. Mr. De, learned Additional Government Pleader submits that the decision on the representation submitted by the petitioner shall be communicated to the petitioner within the time limit as may be fixed by this Court. Without entering into the merits of the claim made by the petitioner in the representation dated 19th January, 2026, WPA 4101 of 2026 stands disposed of by directing the

Block Development Officer, Kultali Block at Jamtala, being the respondent no.3, to consider the representation of the petitioner dated 19th January, 2026 and to dispose of the same by passing a reasoned order after affording a reasonable opportunity of hearing to the petitioner or his authorized representative and communicate the said reasoned order to the petitioner as expeditiously as possible but positively within a period of four weeks from the date of receipt of a server copy of this order along with a copy of the representation of the petitioner dated 19th January, 2026.

In the event, the third respondent finds that any concrete road has been constructed on the property of the petitioner, such authority shall refer the matter to the appropriate authority in case the plot of the petitioner has been utilized without initiating any proceeding for acquisition or requisition.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
