The petitioner submits that partial payment has already been made towards the total claim of Rs.13,09,837/-. The petitioner had completed a work allotted by the Executive Officer, Md. Bazar Panchayat Samiti. Such work involved construction of a boundary wall surrounding the Muslim Graveyard, used by the minorities. The petitioner prays for disbursement of the remaining amount. The learned advocate for the petitioner had filed a representation on behalf of the petitioner, before the Executive Officer, Md. Bazar Panchayat Samiti. The said representation shall be disposed of by the executive officer, in accordance with law upon granting an opportunity of hearing to the petitioner. A reasoned order shall be passed and communicated to all concerned, within a period of four weeks from the date of communication of this order. If the remaining amount is found payable, the same shall be disbursed within a period of two months from such order. If the authority finds that the claim of the petitioner was not genuine, then necessary reasons shall be assigned.

The Court has not gone into the merits of the allegations involved in the writ petition. The Executive Officer, Md. Bazar Panchayat Samiti shall dispose of the matter in accordance with law.

Accordingly, the writ petition is disposed of. However, there will be no order as to costs.

All the parties are directed to act on the basis of the server copy of this order.
