30.09.2022 Ct. 5 D/L 19 ab WPA 3659 of 2022 Sikha Sarkar -VsState of West Bengal & Ors.

Ms. Sarmila Das, ... for the petitioner Mr. Surajit Auddy, Ms. S. Auddy ... for the respondent nos. 2 and 3 Mr. Sandip Kr. Bhattacharyya ... for the respondent no. 4 After hearing learned counsel, it appears that the petitioner's family pension was stopped by the State Bank of India on the petitioner's failure to submit her life certificate from 2014-2021. Although learned counsel appearing for the petitioner submits that the petitioner submitted her life certificates to the Bank every year, there is no such evidence on record. Learned counsel appearing for the Audit and Accounts Department submits that the petitioner's family pension from 2013-21 has already been sanctioned by the State and that the petitioner needs to present herself to the Bank for carrying out the requisite formalities.

WPA 3659 of 2022 is disposed of with liberty to the petitioner to meet the Branch Manager of the concerned Bank and furnish the requisite documents to the Bank. The Bank shall thereafter disburse the family pension to the petitioner in accordance with the documents furnished within a further period of two weeks from the date on which the petitioner meets and completes the formalities. The arrears shall also be paid to the petitioner subject to the petitioner furnishing life certificates as required.
