None appears for the petitioners. However, learned advocate for the respondent no. 5 is present.

As none appears on behalf of the State, Ms. Rupsha Chakraborty, learned advocate, who ordinarily appears for the State, is directed to represent the State. Her appointment may be regularised by the concerned authorities.

Petitioners approached this Court for ensuring adequate assistance/security for the purposes of removing/dismantling fencing from the retail outlet site of the petitioner/company at Plot No. 3679(P), Khatian No. RS 613, LR 676, Mouza Baltikuri, Sheet No. 2, J.L. No. 1, Amta Road, Baltikuri (Kalitala), Dasnagar, Howrah-711113. The prayer was also advanced for free ingress and egress in the premises which was demarcated for a retail outlet.

Learned advocate appearing for the respondent no.5 draws the attention of the Court to the fact that Title Suit No. 49 of 2014 is pending

between the respondent no.5 herein and Indian Oil Corporation.

Having considered that the civil court is already in seisin of the issue, the police authorities would act only, if the civil court passes necessary directions upon the police authorities.

In view of the aforesaid, no interference is called for by this Court.

Accordingly, the writ petition being WPA 3920 of 2024 is disposed of.

Photostat copies relating to Title Suit so handed over by the learned advocate for the respondent no.5 be kept with the record.

Pending connected application, if any, is consequently disposed of.

There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
