24.09.2021 Item no.6 Ct. No.39 CHC (Dissmissed for default) C.R.R. No.522 of 2011 In Re: An application under Section 401 read with Section 482 of the Code of Criminal Procedure.

AND In the matter of:- Brindaban Mondal alias Roy .....petitioner Nobody for the petitioner appears either physically or in virtual mode, when the matter is called on for hearing. No accommodation is proposed for and on behalf of the petitioner.

Yesterday, similarly none appears for the petitioner in spite of the matter being listed.

This is a long pending revisional application relatable to 2011, wherein the order passed by learned Executive Magistrate, 2nd Court, Alipore in M.P. Case No.325 of 2011, under Section 144(2) of the Code of Criminal Procedure is under challenge. Petitioner appears to have lost his interest over this case. No use of getting this matter listed any more. The revisional application being C.R.R.522 of 2011 accordingly stands dismissed for default.

Department is directed to make communication of this order to the concerned learned Executive Magistrate within one week from hence for necessary information.
