It is reflected from the order dated 27th July, 2012 passed by a co-ordinate Bench of this court that the said court refused to extend the interim order. Despite the same, there has been no progress in the session's case relating to Murutia Police Station Case No. 38 of 2010 dated 05.03.2010 under Sections 302/34 I.P.C.

The report so submitted by the Officer-in-Charge, Murutia P.S, Krishnagar Police District dated 16th August, 2021 reflects that the next date has been fixed on 4th October, 2021 for appearance and copy service. Let it be kept with the record.

It is very unfortunate that even a case under Section 302/34 of the Indian Penal Code do not progress in a court of law and surprisingly the commitment of the case to the sessions court is yet to take place.

Learned jurisdictional court is directed to immediately take steps for progress of the case as the report of the Officer-in-Charge, Murutia P.S. Krishnagar Police District reflects a very sordid state of affairs. There is no progress in the case and as such the learned District and Sessions Judge, Nadia would monitor the progress of the case henceforth. Accordingly, the present revisional application being CRR 461 of 2012 is dismissed.

All pending applications, if any, are consequently disposed of.

Department is directed to send a copy of the order to the learned District and Sessions Judge, Nadia. Learned Registrar (Judicial), High Court, Calcutta shall also intimate and monitor that the learned District and Sessions Judge, Nadia has taken effective steps for progress of the trial of the instant case.
