For the State This is an application seeking an expeditious disposal of a proceeding in which a charge sheet was submitted of a proceeding under sections 21 (C) and 29 of the NDPS Act. Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is an accused in this case. He is in custody since the date of his arrest i.e., 28.06.2018. Although, the impugned proceeding was initiated in June 2020, till date even the charges could not be framed. A charge sheet and a supplementary charge sheet have been filed in this case. There are in all eight witnesses mentioned in the charge sheet. The impugned proceeding has been pending for no fault on the part of the present petitioner. The next date has been fixed on 23.02.2021 for consideration of charge. Learned counsel appearing on behalf of the State submits that it will be in the interest of justice if the impugned proceeding is expedited.
I have heard the submissions of the learned advocates for the petitioner and the State and have perused the revision petition. I do not think any delay has been occasioned in conclusion of the impugned proceeding.
However, it is also true that the petitioner is in custody since 28.06.2020.
In view of the above and in the interest of justice, I request the learned trial court to conclude the proceeding as expeditiously as possible without granting any unnecessary adjournment to any of the parties and in particular, to decide the question of framing of charges on the next date of hearing fixed or within fourteen days from such date.
With these observations, the revisional application is disposed of.
