W.P.A. 3667 of 2022 (Krithibas Dasandi & Ors. vs. State of West Bengal & Ors.) Mr. Samiran Mandal Mr Abhinaba Dan .... For the Petitioners Mr. Chandi Charan De Ms. Chandana Ghosh .... For the State Affidavit of service filed by the petitioners is taken on record.

The petitioners claim to be recorded owners of the plot in question and complain that their land has been utilised by the Authorities without acquiring the same or paying any compensation to the petitioners. The petitioners submitted a representation before the concerned Authority on 6th January, 2022 which is yet to be considered. The petitioners pray for direction upon the Authority to consider the representation at the earliest.

Having considered the submissions made on behalf of the parties and material on record, the writ petition is disposed of directing the third respondent to consider and dispose of the representation submitted by the petitioners dated 6th January, 2022 within two

months from the date of communication of this order after giving reasonable opportunity of hearing to all the stake holders including the petitioners, in accordance with law.

The decision taken by the Authority shall be communicated to the petitioners within a week thereof. W.P.A. 3667 of 2022 is thus disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
