The petitioner is the plaintiff in Misc. Case No.28 of 2013 which is pending before the learned Civil Judge (Junior Division), 2nd Court at Barrackpore, District - North 24 Parganas. The petitioner prays for expeditious disposal of the preemption case.

It is submitted that although the suit is at the stage of evidence, there has hardly been any progress and the suit is being adjourned repeatedly.

This Court has not gone into the merits of the suit. An order of expeditious disposal of any litigation enures to the benefit of all the parties and hence prior service of this revisional application upon the opposite parties is not required. The prayer is innocuous.

Under such circumstances, considering the age of the suit and considering the submissions made by the learned advocate for the petitioner, this Court is directs the learned Civil Judge (Junior Division), 2nd Court at Barrackpore to dispose of the Misc. Case No.28 of 2013 within a period of six months from the next date fixed mandatorily, without granting unnecessary adjournments to either of the parties.

The learned court below shall proceed in accordance with law and independently.

Accordingly, the revisional application is disposed of. However, there will be no order as to costs.

Petitioner is directed to serve a copy of the revisional application upon the opposite parties, along with the server copy of this order.

Urgent photostat certified copy of this order, if applied for, be given to the parties on priority basis. (Shampa Sarkar, J.)
