Heard learned counsels for the parties.

Learned counsel for the respondents produces two letters issued by the Executive Engineer, Kakdwip Irrigation Division issued on 8th December, 2023 and submits, on instructions, that the respondents propose to purchase the plot of the petitioners directly since the said plot has been utilized for construction of ring bandh without acquisition. The petitioners agree to the proposal for direct purchase subject to payment of current market value of the plot in question by the respondents. In view of the above, the Executive Engineer, Kakdwip Irrigation Division, South 24 Parganas, being the 6th respondent herein, is directed to initiate the process of direct purchase of the plot in question and conclude the entire process within four months from the date of communication of this order upon affording reasonable

opportunity of hearing to all concerned including the petitioners, in accordance with law.

Respondent nos.1 and 5 are also directed to take necessary steps for direct purchase of the plot in question within the stipulated time frame.

Since nothing further remains to be adjudicated in the writ petition, the same is disposed of.

There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
