Liberty is granted to the petitioner to amend the Cause Title. Learned advocate for the petitioner submits that petitioner is similarly situated as the other accused person who has been granted bail in CRM (NDPS) 292 of 2026. The subject matter of the case relates to alleged recovery of 400 bottles of RC cough syrup. Learned advocate for the State opposes the prayer for bail and submits that charge-sheet has been submitted and witness action will commence on the next date.

Be that as it may, having considered the quantum of recovery and the period of detention of the petitioner and some time will be required to conclude the trial, I am of the view that further detention of the petitioner is unwarranted. Accordingly, the prayer for bail of the petitioner is allowed.

As such, petitioner namely, Md. Anoar Sk @ Md. Anowar Sk shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Judge, Special Court under NDPS Act cum learned Additional Sessions Judge, 5th Court, Berhampore, Murshidabad.

If on bail, the petitioner shall be physically present on each and every date before the learned trial Court in seisin of the case and shall not leave the jurisdiction of district of Murshidabad without prior permission of the learned Special Court. Accordingly, the prayer for bail in CRM (NDPS) 342 of 2026 is allowed.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
