Learned counsel appearing on behalf of the petitioner submits that he is being falsely implicated by the local police. Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail and relies on a report which is taken on record. As per the report, there are as many as eight criminal cases pending against the present petitioner since 2002. While the case of 2002 relates to an offence of attempt to murder, the case lodged on 18.03.2024 relates to an offence of murder. There are also cases under the Arms Act and even under the POCSO Act.
There is another case involving offences under the NDPS Act as well. However, there is no money trail or CDR analysis of phone conversation details to implicate the petitioner. The phone conversations could not be tested as the mobile number of the petitioner was not available.
Considering the materials available in the case diary and the criminal antecedents of the petitioner including one involving offences under the NDPS Act and the restriction contained in Section 37 of the NDPS Act, I do not consider this is to be a fit case for granting anticipatory bail.
Accordingly, the application for anticipatory bail of the petitioner is rejected.
