Mr. Sirsanya Bandyopadhyay Ms. Deboleena Ghosh ... for the petitioners This application under Article 227 of the Constitution of India is at the instance of the defendants praying for a direction upon the learned Additional District Judge, 1st Court at Alipore, South 24 Parganas to dispose of the Miscellaneous Appeal no. 21 of 2024.

From the order-sheets in connection with the miscellaneous appeal appended to this civil revisional application, this Court finds that 13th March, 2025 has been fixed for appearance of the respondent no.9. Since the respondent no.9 is yet to appear in the appeal, this Court is not inclined to pass any peremptory directions for hearing of this miscellaneous appeal.

In view of the order sought and proposed to be passed, there is no necessity to direct issuance of notice upon the opposite parties. However, the learned advocate appearing for the petitioner shall

be obliged to serve a copy of this application along with this order upon the opposite parties or their learned advocates representing them before the learned 1st Appellate Court. After the appeal is made ready for hearing, the learned Additional District Judge, 1st Court at Alipore, South 24 Parganas shall make all endeavour to dispose of the Miscellaneous Appeal No. 21 of 2024 expeditiously without granting any unnecessary adjournment to either of the parties.

Accordingly, C.O. 594 of 2025 stands disposed of.

No order as to costs.
