1. Affidavit of service is taken on record.

2. The present writ petition has been filed alleging illegal construction made by the private respondent no. 5 over the holding no. 35, Abdul Latif Lane, Munshi Bazar, Asansol, under ward no. 44, Asansol Municipal Corporation, district Paschim Bardhaman.

3. It is the case of the petitioner that the private respondent no. 5 is a local influential person and they have started illegal and unauthorized construction by force over the aforesaid plot of land without having any sanctioned plan from the Asansol Municipal Corporation and in violation of the Rules and Regulations of the West Bengal Municipal Corporation Act, 2006.

4. Learned counsel for the petitioner contends that he had made a representation dated 15.1.2025 before the Commissioner, Asansol Municipal Corporation. Despite the said representation, no substantive action has been taken by the

respondent- municipality to halt the illegal construction which stands as a menace in the locality which may collapse at any moment causing serious casualty even loss of life in the locality.

5. Despite service nobody appears for the respondent Corporation.

This court directs the Commissioner, Asansol Municipal Corporation to decide the petitioner's representation dated 15.1.2025 by way of a speaking order within a period of six weeks from the date of communication of this order after affording an opportunity of personal hearing to the petitioner as well as the private respondent.

7. With the above direction the present writ petition is disposed of.
