W.P.A. 3678 of 2022 (Bimal Mandal vs. State of West Bengal & Ors.) Mr. Manoranjan Mahata .... For the Petitioner Mr. Chandi Charan De .... For the State Affidavit of service filed by the petitioner and the report filed by the State are taken on record. The petitioner's grievance is that his land has been acquired by the State Authority but no compensation has been paid to him in lieu of such acquisition. The petitioner submitted a representation before the concerned Authority in this regard which was received on 15th February, 2022 but the same has not yet been considered.

It is submitted on behalf of the State respondents that pursuant to the representation submitted by the petitioner the Block Land and Land Reforms Officer has been requested to demarcate the extent of Government land in front of the house of the petitioner in order to verify the allegations made by the petitioner and the same is in progress.

In view of the fact that that steps have been taken pursuant to the representation submitted by the petitioner, this Court is inclined to hold that the concerned Authority should be directed to complete the entire exercise within two months from the date of communication of this order.

Accordingly, the writ petition being W.P.A. 3678 of 2022 is disposed of directing the 4th respondent to conclude the entire process in the light of the representation made by the petitioner within two months from the date of communication of this order. In the event it is found that the petitioner is entitled to compensation, such compensation should be paid to the petitioner within a month thereof.

W.P.A. 3678 of 2022 is thus disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
