Sn 18.2.21 C.O. 334 of 2021 With C.O. 331 of 2021 BABA BHUTNATH CONSTRUCTIONS PRIVATE LIMITED VS. GOVARDHAN DAS BINANI & ORS.

Mr. Sourdipta Banerjee Mr. Rakesh Jain ..for the petitioner C.O. 334 of 2021 arises out of Title Suit No.1277 of 2017 pending before the learned judge, 8th Bench ,City Civil Court, at Calcutta.

The petitioner prays for expeditious disposal of the title suit. The said title suit has been fixed for framing issues. Records reveal that the said suit is being heard analogously with Title Suit 746 of 2018. The petitioner also filed C.O.331 of 2021 praying for expeditiously disposal of the said suit as well. However, as both the suits are running analogously, by this composite order these revisional applications being C.O. 331 of 2021 and C.O. 334 of 2021 are disposed of and with a direction upon the learned Court below to expedite the hearing of the said suits and dispose of the same by allowing the opposite parties to contest the same.

This Court has not gone into the merits of the claim and counterclaim of the parties and the learned

Court below shall proceed independently and in accordance with law without being influenced by any observations made hereinabove.

The petitioner is directed to serve a copy of the revisional applications along with a server copy of this order upon the opposite parties as also the learned Advocate for the opposite parties in the learned Court below within a week from date.

These revisional applications are disposed of. There will be however no order as to costs.

Urgent photostat certified copy of this order be given to the parties on priority basis, if the same is applied for.
