C.R.R. 180 of 2014 With CRAN 1 of 2014 (Old CRAN 3905 of 2014) Asis Mitra & Anr.

Vs.

State of West Bengal & Anr.

Mr. Arijit Ganguly ..For the State.

As none appears on behalf of the State, Mr. Arijit Ganguly, learned advocate who ordinarily appears for the State, is directed to appear in this matter. His appointment may be regularized by the concerned authority.

The present revisional application has been preferred in the proceedings arising out of Narkeldanga Police Station Case No. 173 of 2012 dated 28.5.2012 under Section 324/114 of the IPC. The petitioners approached this Court at the stage when the charge sheet were submitted before the Jurisdictional Court and the learned Court on perusal of the materials on record so appearing/collected by the Investigating Agency was pleased to take cognizance of the offence. None of the documents under Section 207 of the Cr.P.C. were relied on by the petitioners at the relevant stage. Further the documents which has been enclosed with the revisional application are the documents which can be relied on only at the stage of trial and cannot be

appreciated at the stage when the Court has not progressed for consideration of charges.

Thus no interference is called for.

Accordingly C.R.R. 180 of 2014 is dismissed.

Consequently the application being CRAN 1 of 2014 (Old CRAN 3905 of 2014) is also dismissed.

Interim order, if any, is hereby vacated.

All pending connected applications, if any, are consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
