C.R.R. 187 of 2014 Dipankar Nayak Vs.

State of West Bengal.

The revisional application was preferred challenging the charge sheet which was filed in connection with Contai Police Station Case NO. 197 of 2013 dated 10.6.2013 under Sections 365/366/376/120B/34 of the IPC.

The petitioner approached this Court at a stage when the learned Additional Chief Judicial Magistrate, Contai was pleased to commit the case to the Court of Sessions accepting the report under Section 173 of the Cr.P.C. None of the documents under Section 207 of the Cr.P.C. has been relied upon on enclosed along with the revisional application for proper adjudication of the case. Further the grounds which are taken up in the revisional application relate to question of facts which can be adjudicated only at the stage of trial. As none appears on behalf of the State, Mr. Arijit Ganguly along with his junior Ms. Manisha Sharma, learned advocates who ordinarily appear for the State, are directed to appear in this matter. Their appointment may be regularized by the concerned authority. Accordingly, C.R.R. 187 of 2014 is dismissed.

All pending connected applications, if any, are consequently disposed of.

Interim order, if any, is hereby vacated.
