The petitioner claims that his Pan Boroj has been damaged in view of Amphan Cyclone and, accordingly, he claims relief under the Amphan Cyclone Relief Fund for his Pan Boroj.
A list of beneficiaries was prepared by the Block Development Officer wherein his name does not appear. The petitioner filed a representation before the Block Development Officer on 29th May, 2020 followed by reminders dated 13th August, 2020, 6th October, 2020 and 29th December, 2020. The grievance of the petitioner is that none of the representations have been considered by the respondent authorities till date.
As it appears that the Government has already awarded relief in favour of certain persons who were affected by the Amphan Cyclone and the petitioner claims
that he has also suffered a lot because of the said cyclone and has prayed relief for his Pan Boroj and his application remains pending accordingly, the instant writ petition being W.P.A. 4520 of 2021 is disposed of by directing the respondent no.5 being the Block Development Officer, Contai-I Block, to consider the representation filed by the petitioner, strictly in accordance with the scheme relating to payment on account of Amphan Cyclone at the earliest, but positively within a period of twelve weeks from the date of communication of a copy of this order. The petitioner shall be afforded an opportunity of hearing prior to taking decision in the matter and the aforesaid respondent shall communicate the reasoned order to the petitioner immediately.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon completion of usual legal formalities.
