Perused the report filed by the Additional Secretary to the Government of West Bengal, Judicial Department wherefrom it appears that the Judicial Department took up the matter with the Home Department for consideration of the recommendation made by SSRB for premature release of the petitioner but the Home Department rejected the recommendation for premature release.

As the recommendation of the SSRB has not been accepted by the Home Department, accordingly, the prayer sought for by the petitioner for premature release cannot be allowed.

The writ petition fails and is hereby dismissed.

It will be open for the petitioner to take necessary steps in the matter in accordance with law.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
