rkd 12.02.2021 Ct. no.32 C.R.R. 383 of 2021 In the matter of: Rudra Prasad Ghatak ....petitioner.

Mr. A. Ghosh ...for the petitioner.

Mr. S.G. Mukherjee, Ld. P.P., ...for the State This is an application seeking an expeditious disposal of a proceeding in which a charge sheet was submitted under Sections 420, 406, 120B and 506(II) of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is the defacto complainant in this case. He filed an application under Section 156(3) of the Code. Pursuant to a direction passed in this case, an F.I.R. was registered on 4.8.2018. After completion of investigation, a charge-sheet was submitted on 17.3.2019 and cognizance was taken on the selfsame date. 15.11.2019 was the last date fixed for supplying of copies to the accused. Till date supply of copies could not be effected upon the accused. The proceeding has largely remained pending for no fault of the present petitioner. The learned counsel for the State submits that the impugned proceeding ought to be expedited in the interest of justice.

I have heard the submissions of the learned counsel appearing on behalf of the petitioner and the State and have perused the revision petition.

No prejudice will be caused to anyone if a direction for an expeditious disposal of the proceeding is passed in this case.

It appears that some delay has been occasioned in concluding the impugned proceeding and supply of copies to the accused has remained stalled since 15.11.2019. In view of the above and in the interest of justice, I request the learned trial court to conclude the proceeding as expeditiously as possible without granting any unnecessary adjournment to any of the parties and complete the process of supplying of copies upon the accused on the next date fixed or within fourteen days from that date and thereafter decide the question of framing of charge within three months therefrom. With these observations, the revisional application is disposed of.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings. (Jay Sengupta, J.)
