For the State Dr. Madhusudan Saha Roy .... For the CESC This is the second round of litigation between the parties. In an earlier writ petition by an order dated 22nd April, 2019 , a learned Single Judge of this Court had directed the matter to be adjudicated by the District Magistrate. It is submitted on behalf of the parties that by an order dated 30th July, 2019 the District Magistrate had considered and disposed of the representation filed on behalf of the petitioner's predecessor-in-interest.

The CESC is represented and submits that they have no objection in complying with the aforesaid directions of the District Magistrate dated 30th July, 2019. This submission is not opposed by the petitioner.

In view of the submissions made on behalf of the parties, I direct that the order of the District Magistrate dated

30th July, 2019 (Annexure P/5 at page 42 of the petition) be complied with by the CESC authorities subject to compliance of all requisite formalities by the petitioner. The CESC authorities are directed to complete the entire exercise within a period of four weeks from date. The Officer-in-Charge of Rabindranagar Police Station is directed to give all necessary police assistance, if necessary to the respondents CESC authorities and their authorised representatives. The cost of the entire exercise for connection of such electric meter is to be borne by the petitioner.

With the aforesaid directions, W.P.A. 4536 of 2021 is disposed of.

There shall be no order as to costs.
