The petitioner is aggrieved that his application for issuance of permit as submitted before the RTA, Paschim Bardhaman, in statutory form-I, along with the requisite statutory fees on September 12, 2024, has not been considered by the said authority, in spite of lapse of six months period of time in between. Mr. Nandi, learned advocate for the petitioner insists that an order be passed directing the said authority to consider immediately the petitioner's application as above.
Mr. Deb Roy, learned advocate is appearing for the State respondent. Mr. Deb Roy submits that the application of the petitioner for issuance of permit on the route "Benachity to Durgapur station" shall be considered by the Board, in due course of time. Heard submissions of the learned counsels.
It appears that from the date of submission of the application and the fees by the petitioner, a period of six months have already elapsed, whereas in terms
of the West Bengal Motor Vehicles Rules, 1989, the RTA, Paschim Bardhaman, is to hold its meeting once in every four months, for the purpose of consideration of applications for issuance of the permit.
Therefore, let this writ petition be disposed of by directing the respondent no.2, RTA, Paschim Bardhaman, to consider and dispose of the petitioner's application for issuance of permit dated September 12, 2024, within a period of eight weeks from the date of receipt of copy of this order and in accordance with law, after affording adequate reasonable opportunity of hearing to the petitioner.
Let the respondent no.2 communicate its decision as regards the application of the petitioner as mentioned above, within one week from the date of its order.
The writ petition is disposed of with the above observations and directions.
Since no affidavit has been called for, allegations made in the writ petition, shall be deemed to have not admitted by the respondents.
Urgent certified photocopy of this order, if applied for, shall be supplied to the parties, on compliance of all necessary formalities.
