Learned advocate for the petitioner submits that petitioner is in custody for one year eighteen days and although witness actions has commenced but the evidence which has surfaced according to the petitioner do not inspire confidence. Learned advocate submits that there is no possibility of the trial concluding in near future, as such petitioner may be released on bail.

Learned advocate for the State opposes the prayer for bail and submits that recovery was from the exclusive possession of the petitioner and prayer for bail of the present petitioner was rejected on 20.01.2026. Learned advocate submits that four more witnesses are to be examined.

Having considered the stage of the trial and the quantum of recovery which is 33.50 kgs of ganja, I am not inclined to release the petitioner on bail.

Accordingly, the prayer for bail of the petitioner in CRM (NDPS) 344 of 2026 is dismissed.

The observations made above are strictly for the purpose of consideration of the bail application. The learned trial Court will independently consider the merits of the case while deciding the outcome of the case.
