1. In this application, the petitioner has prayed for expeditiously disposal of G.R. Case No. 244/2014 presently pending before learned Additional Chief Judicial Magistrate, Gangarampur at Buniadpur.

Being aggrieved by the inordinate delay caused in disposal of the said proceeding, learned Counsel for the petitioner submits that aforesaid proceeding was initiated against the petitioner under Sections 498A/34 of Indian Penal Code on 16th March, 2014. After completion of investigation, Police submitted charge-sheet on 31st May, 2014. The charge was framed three years thereafter on 11th September, 2017. Since then for last about 9 years only one witness could be examined in part whereas the prosecution proposes to examine 11 witnesses in the said proceeding. He further submits that the trial has got stalled completely since 4th

July, 2019. Therefore, he prayed for necessary direction upon the Court below for expeditious disposal of the said proceeding.

Having heard learned Counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made in the application the opposite parties will have no cause to prejudice and as such service of copy of application upon the opposite parties is dispensed with.

4. Having heard learned Counsel for the petitioner and that the trial of the said proceeding has got stalled for about seven years, I find that the prayer made by the petitioner is justified and required to be allowed to secure the ends of justice. In view of above, the instant proceeding being CRR/792/2025 is hereby disposed of with a direction upon the Court below to make every endeavour for expeditious disposal of the proceeding being G.R. Case No. 244/2014 presently pending before learned Additional Chief Judicial Magistrate, Gangarampur and to make his best effort to conclude the entire proceeding within a period of six months from the next date of hearing.
