03.03.2022 Ct. No 29 KAUSHIK (REJECTED) C.R.M. (A) 1069 of 2022 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Golfgreen Police Station Case No. 27 of 2022 dated 03.02.2022 under Section 417/376/420 of the Indian Penal Code. And In Re : Dipanjan Sadhukhan ..... petitioner Ms. Subhasree Patel Mr. Soham Banerjee Ms. Puja Mahapatra .... for the petitioner Mr. Gora Chand Samanta .... for the de-facto Mr. Bidyut Kumar Roy Ms. Rita Dutta ... for the State Petitioner seeks anticipatory bail.

Learned advocate appearing for the petitioner submits that, the petitioner was falsely implicated. She draws the attention of the Court to the general diary made on behalf of the petitioner. She submits that the police complaint is a result of love relationship turning sour.

Learned advocate appearing for the State draws the attention of the Court to the statement of the victim recorded under Section 164 of the Code of the Criminal Procedure (Cr.P.C.).

Learned advocate appearing for the de-facto complainant submits that, the petitioner took objectionable pictures of the de-facto complainant and threatened to circulate the same. Learned advocate appearing for the petitioner submits that, in fact, it is the petitioner who was blackmailed by the defacto complainant over a period of time.

Considering the gravity of the offence and the involvement of the petitioner therein and considering the 164 Cr.P.C. statement of the victim, which speaks of not only being ravished by the petitioner but also of objectionable photographs of her being taken, we are unable to grant anticipatory bail to the petitioner.

Accordingly, prayer for anticipatory bail of the petitioner is rejected and the application being CRM (A) 1069 of 2022 is dismissed.
