gd/ssd WPA(P)/92/2022 ALOKESH SARDAR AND OTHERS VS STATE OF WEST BENGAL AND ORS..

Mr. Jahar Lal De, Mr. Supratim Dhar ..for State.

Mr. S.K. Panja, Mr. Sumit Ray ..for the W.B.S.E.T.C.L.

1. None for the petitioners.

2. Learned counsel for the respondent no.7 raised the question of maintainability of this PIL by contending that the petitioners may be claiming benefit as against their land which is being used for drawing the transmission line by respondent no.7.

3. In that case the petitioners are "persons aggrieved" and they can file regular proceeding before appropriate forum.

4. No larger public interest is involved in this matter. More so, when WBSETCL has not received any complaint in respect of non-payment of compensation.

5. The petitioners have not chosen to appear for the reason best known to them.

6. We find substance in the objection of counsel for the respondent no.7 and accordingly, this PIL is disposed of by permitting the petitioners to avail the remedy before the appropriate forum available under the law.
