1. Heard the learned advocate for the appellants and the learned advocate for the respondents.
2. The writ petitioners had approached the Writ Court on being declared ineligible in the Physical Measurement Test (PMT) being conducted in the recruitment process for recruitment of Constables in the West Bengal Police. The recruitment process is of the year 2024.
3. The writ petitioners were found to be deficient in height measurement disqualifying them in the PMT. They preferred an appeal as provided in the advertisement before the Chairperson of the Selection Board/Committee on the same day of their test. Pursuant to such appeal being filed they were accorded a remeasurement. They once again failed the PMT on the ground of deficiency in height, the degree of deficiency was, however, at variance.

The Writ Court having noticed the fact that the writ petitioners had availed the remedy of appeal decided to give the issue a quietus as there was no ground made out for interfering with the assessment/re assessment. The writ petitioners/appellants having exhausted their remedy of departmental appeal were, therefore, not afforded any further opportunity in this regard.

The learned advocate for the writ petitioners submits that in view of the variation in height measurement occurring by the Board in between the two stages, once in the PMT; and second in the departmental appeal, the measurement cannot be said to be a truthful and a proper measurement and, therefore, an opportunity should have been given for re-measurement of the height.
6. The learned senior advocate for the respondent Board on the other hand submits that the writ petitioners have availed the appellate remedy in the recruitment process unsuccessfully. A mere variation in the measurement of height at two different stages cannot ipso facto form a ground for discrediting the result, more so when at both stages the writ petitioners consistently emerged below the requisite height criteria. In absence of any infirmity/illegality in the process and in absence of any specific malafide allegation, the Writ Court rightly refused to interfere with the height measurement.
7. We have considered the rival submissions. We are in agreement with the submissions advanced on behalf of
the learned senior advocate representing the Board. The variation in the measurement at the two stages is minuscule, by a margin of 1 c.m. or even less. It is common knowledge that a measurement is influenced by various factors which may include the time at which the measurement is being done and several other factors. The variation founded on such variables applies uniformly to one and all in the recruitment process.
8. It is not the case of the writ petitioners that they were in any manner discriminated against, or that the recruitment process was flawed having any element of bias or malafide. In absence of such allegations and when no such case is made out, merely because a negligible variation in the height measurement has occurred, the Writ Court should not interfere. Therefore, we are of the view that the Hon'ble Single Judge rightly refused to afford any further opportunity to the writ petitioners.
9. We find no infirmity in the decision of the Hon'ble Single Judge in this regard.
10. The appeal is dismissed. Pending application is also dismissed.
