Learned counsel for the petitioner submits that the petitioner is in custody for about a year. Investigation is complete. Her further detention is not required. She may be granted bail.
Opposing the prayer learned counsel for the State submits that supplementary charge sheet has been submitted upon completion of further investigation. The petitioner is not co operating in investigation and the amount of money is yet to be recovered. The bank challans were recovered pursuant to the leading statement of the petitioner. The challans manufactured by the petitioner to indicate deposit of the money in the government account have been found to be fake. The signatures in the documents have matched with that of the petitioner as
appears from the report submitted by the Questioned Documents Examination Bureau.
I have considered the material on record. The petitioner appears to be the principal accused of the case. Co accused who has been released on bail does not stand on the same footing as the petitioner. Other accused is still absconding.
Considering the extent of complicity of the petitioner in the alleged offence as well as material available on record this Court is not inclined to enlarge the petitioner on bail at this stage.
Accordingly the prayer for bail is rejected at this stage. The application for bail is thus disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
