Heard learned counsels for the parties.

The grievance of the petitioner is non-payment of gratuity.

The petitioner was employed under the 4th respondent and superannuated on 30th June, 2019. Several applications filed by the petitioner before the employer for payment of gratuity fell on deaf ears and the petitioner ultimately submitted an application in Form-I before the 4th respondent on 6th March, 2021 which was also not considered. Subsequently, the petitioner filed an application in Form-N before the 3rd respondent on or about 29th November, 2021 which is still pending. The

petitioner prays for expeditious disposal of the application by the 3rd respondent.

Upon hearing the submissions made on behalf of the parties, the writ petition is disposed of directing the 3rd respondent to consider and dispose of the application in Form-N submitted by the petitioner on 29th November, 2021 within four months from the date of communication of this order after giving reasonable opportunity of hearing to all the interested parties including the petitioner, in accordance with law.

The decision taken by the authority shall be communicated to the petitioner within a period of one week thereafter.

With the above observations and directions this writ petition being WPA 3706 of 2022 is disposed of. However, there shall be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
