2. The petitioner alleged to be a tenant of the mortgaged property. The petitioner claims that he is neither a borrower nor a guarantor nor in any manner connected with the loan account concerned. In fact, the petitioner claims to be a pre-mortgage tenant in respect of the said property.

3. The petitioner has a statutory remedy before the Debts Recovery Tribunal which he ought to avail before moving a Writ Court having jurisdiction under Article 226 of the Constitution of India.

4. WPA 3928 of 2026 is dismissed without any order as to costs.
