Case No. 555 of 2022 arising out of Matrimonial Suit No. 1507 of 2022. A co-ordinate bench by an order dated 19th September, 2024 referred the matter to the mediator to facilitate the mediation. Today, when this matter is taken up for hearing, learned advocates for the respective parties uniformly submitted that final settlement has been arrived at between the parties which has been recorded in the final report of the mediator. The final report of the mediator is in the records of this case.

After going through the final report this Court finds that the husband/petitioner herein has agreed to withdraw the Matrimonial Suit No. 1507 of 2022 pending before the learned Additional District Judge, 7th Court at Alipore. On the same day the parties shall file an application under Section 13B of the Hindu Marriage Act, 1955 before the learned District Judge praying for decree of divorce for mutual consent.

Learned advocate appearing for the petitioner submits that in view of the settlement arrived at before the mediation, the petitioner is not willing to proceed with this civil revisional application.

Regarding such submission, this civil revisional application stands disposed of with liberty to the parties to take appropriate steps as per the final settlement arrived at between the parties.
