2. This is an application for condonation of delay of 76 days in filing the appeal.

3. Considering the averments in paragraphs 2 and 3 of the application, we are satisfied that the appellants were prevented by sufficient cause from filing the appeal within time.

4. Delay is condoned.

5. Accordingly CAN 2 of 2026 is allowed.

6. Let the appeal be regularized.

In Re: MAT 302 of 2026

7. The appellant is aggrieved by an order dated November 3, 2025, passed in WPA No.14541 of 2025.

8. The learned Single Judge recorded that the appellant had alleged that the respondent nos.5 and 6 in the writ petition had caused an obstruction to the egress and ingress to the residential premises of the appellant by blocking a road, which was a private dispute, civil in nature. His Lordship recorded that the letter written by the appellant to the panchayat authority did not disclose that the allegation was with regard to the violation of any of the provisions of the West Bengal Panchayat Act.

9. In our opinion, the tenor of the complain appears to be allegations of commission of criminal offences. The crux of the complaint is quoted below:- "......above named persons who are blocking the said road and not allow my client to use the said road and thereafter there is having some disputes regarding the use of the said road the above mentioned persons used filthy language and warned them not to use the said road and also taunted and molested to my client and therefore my client run to the police station and lodge a written complaint on 14.05.2025 but police has lodge a FIR being no.127/25 against them on 24.05.2025 under Sections 126(2)/115(2) 117(2) of BNS but till date no action has been taken by the said concerned police officers and day by

day the said above noted persons are creating trouble by way of blocking the said road and when my client and her family members raise any objection they became furious and limit the cross of a civilized person."

10. Under such circumstances, we do not find any reason to interfere with the order impugned.

11. Accordingly, the appeal and the connected application being CAN 1 of 2026 are disposed of.

12. Parties are directed to act on the basis of the server copy of this order.
