Petitioner has approached this Court in respect of certain disputes with the adjacent land owner but presently his grievance is with respect to the respondent no.3 who was the Enquiry Officer associated with Gosaba Police Station. Being aggrieved by the act and action of the concerned police officer/Assistant Sub-Inspector of Police, petitioner earlier approached this Court but since the act and action of the police officer was in discharge of certain official duties this Court refused to pass any necessary orders in WPA 15777/2024. Subsequent to the order being passed the petitioner on or about 2nd of December, 2024 made a representation to the Office of the Director General of Police Bhabani Bhawan, West Bengal which was received by the said Office. Petitioner is therefore aggrieved that no information has been

furnished pursuant to the representation received by the Office of the private respondent no.2.

State has submitted a report. The report deals with nature of dispute persisting at the ground reality between the petitioner and the adjacent land owner and to that effect what steps taken by the Gosaba Police Station.

Since presently the petitioner has restricted his prayer for non-consideration of the representation made to the Director General of Police, Bhabani Bhawan, West Bengal, I direct that the concerned Office would consider the representation of the petitioner in accordance with law by the first week of April, 2025 and inform the outcome to the petitioner within a fortnight thereafter. With the aforesaid observations WPA 4036 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
