Affidavit of service filed by the petitioner is taken on record.

None appears for the respondents despite service. The petitioner was granted contract for construction of mooram road from the house of one Sadek Ali to the house of one Abdul Sk. in village Charbathanpara in terms of a work order issued in his favour on 19th February, 2013. The total value of the said construction was Rs.12,99,238/-. Upon completion of the said work, the petitioner received an amount of Rs.8,01,900/- and the balance amount of Rs.4,91,429/- remained due. The petitioner made a representation before the concerned authority on 23rd July, 2018 for clearance of the said due and no step being taken, he approached this Court in a writ petition being WPA 24803 of 2018. By an order passed on 7th January, 2021, a coordinate Bench of this Court directed the Pradhan, Malibari Gram Panchayat to deal with the representation within three weeks from the date of communication of the order and disburse the amount claimed or part thereof accompanied by reasons as

to why some or whole of it was not payable. The petitioner seeks implementation of the said order.

In view of the fact that the order passed by this Court on 7th January, 2021 is yet to be complied with, the Pradhan, Malibari Gram Panchayat, being the 4th respondent herein, is directed to comply with the said order in its true letter and spirit within six weeks from the date of communication of this order, upon granting reasonable opportunity of hearing to the petitioner.

The writ petition is accordingly disposed of. There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
