The petitioner claims that she is the daughter of one Chittaranjan Mondal an ex-employee of the Shyama Prasad Mukherjee Port Trust.

After the death of the father of the petitioner her mother Gita Mondal enjoyed pension until the mother's death on March 18, 2019. The petitioner got married in September 2016 and her husband died on June 7, 2017. The petitioner made representation before the employer for pension in place and stead of her mother. The representation is pending consideration.

In those circumstances, the respondent Shyama Prasad Mukherjee Port Trust is directed to consider the petitioner's representation for pension within a period of 3 months from the date of communication of a copy of this order.

It is made clear that since the respondents have not used any affidavit, none of the allegations made in the writ application shall be deemed to have been admitted.

With the above observations, the writ petition is dispose of.

There shall be no order as to costs.

Urgent photostat certified copy of this judgment, if applied for, be given to the parties upon compliance of all formalities.
