The petitioner is the widow of a deceased employee of the Bidhannagar Municipal Service Division. The petitioner seeks release of death benefit of the employee. Learned advocate representing the State respondents submits that the instant writ petition seeking death benefit at the instance of the widow of a Government employee, will not be maintainable. It has been submitted that the employee will be governed by the WBSR I and WBSR II and other relevant orders of the Government of West Bengal.

It appears that the writ petition will indeed not be maintainable as the employee was a Government employee and there is a separate forum for redressal of their grievances.

In view of the above, it will be open for the petitioner to approach the appropriate forum for relief.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
