for the Petitioner Ms. Sudeshna Majumdar ... for the respondent no.3 This is an application under Article 226 of the Constitution of India wherein the writ petitioner is aggrieved by the inaction on the part of the school authorities in forwarding the documents in relation to deduction of salary for three days before the District Inspector of Schools (S.E.), at Kolkata.

The case of the petitioner is that three days' salary has been deducted with ulterior motive and the school authorities are not acting on the representation of the petitioner. Despite service none appears on behalf of the school authorities. I draw an adverse inference on the school authorities.

I have heard learned Counsel for the appearing parties and perused the materials on record.

Accordingly, I direct the school authorities to refund the deducted amount of three days' salary to the petitioner and also direct the school authorities to send the requisition as per

law to the concerned District Inspector of Schools (S.E.) and the District Inspector of Schools (S.E.) is directed to act expeditiously in accordance with law.

With the above directions, this writ petition is disposed of.

Since no affidavit-in-opposition is called for, allegations made in the writ petition are deemed not to have been admitted.
