Having regard 20-09-2024 AKG Ct. 15 to the averments made in paragraph no. 4 of this application, I am of the view that the petitioner has sufficiently explained the reason for his non-appearance on May 1, 2024.

Accordingly, CAN 1/2024 is allowed and this writ petition is restored to its original file and number. In Re.: WPA 4064 of 2024 Let the affidavit of service filed by the petitioner be kept with the records.

The petitioner alleges unauthorised construction at the behest of respondent nos. 9 to 11 at premises no. B/2/H/27, Gopal Mukherjee Road, P.S. - Chitpore, Kolkata - 700 002.

The report filed by the Corporation goes to suggest that a proceeding under Section 400 (1) of the Kolkata Municipal Corporation Act, 1980, has already been initiated against the persons responsible for the unauthorised construction.

In that view of the matter, I dispose of this writ petition with a direction upon the Corporation to conclude the proceedings within a period of three months from the date of communication of this order in accordance with law.

Accordingly, WPA 4064 of 2024 is disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
