Learned advocate for the petitioner submits that the subject matter of recovery in the present case is 7820 bottles of codeine phosphate and the petitioner has surrendered before the jurisdictional Court and is in custody for 51 days. It has further been submitted that petitioner has been implicated on the basis of statement of co-accused person.

Learned advocate for the State opposes the prayer for bail and has referred to the deposition of the seizure list witnesses. Petitioner has surrendered very recently in January, 2026 after one year of submission of charge-sheet, charges have already been framed.

Petitioner is granted liberty to renew his prayer for bail after the evidence of other seizure list witnesses is completed.

At this stage, I am not inclined to release the petitioner on bail.

Accordingly, the prayer for bail of the petitioner in CRM (NDPS) 349 of 2026 is dismissed.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
