Heard the learned Advocates for the parties.

We have considered the materials on record. Petitioner is a neighbour of the victim's wife. There was matrimonial discord and victim's wife was living at her parental home. On the fateful day, victim came to his in-laws residence and thereafter suffered unnatural death. Post mortem report shows he had died due to hanging i.e. suicide. No suicide note was left behind by the deceased. Though statements of witnesses show petitioner and co-accused had ill treated the victim, but whether such conduct would constitute abetment to suicide has to be assessed at the appropriate state of the proceeding.

Under such circumstances, we are inclined to grant bail to the petitioner.

Accordingly, we direct that in the event of arrest, the petitioner viz., Prodip Tudu be released on bail upon furnishing a bond of Rs.10,000/-, with two sureties of like amount each, to the satisfaction of the Arresting Officer and also subject to the

conditions as laid down under Section 482(2) of the BNSS. He shall appear before the jurisdictional court and pray for regular bail within four weeks from date.
