Mr. S. Basu, Mr. Supratim Loha, Mr. Binay Kumar Jain ...for the petitioner A direction to secure expeditious disposal of a suit being Title Suit No.1761 of 2013, now pending before learned Judge in Charge, XIth Bench, City Civil Court, at Calcutta, is the ultimate relief sought for in this case.
Mr. Basu, learned advocate appearing for the petitioner submits that suit is getting delayed for the absence of regular Judicial Officer being posted in respect of XIth Bench, City Civil Court. This is also contended that the injunction application has not yet been disposed of.
In view of the nature of order proposed to be made in this case, no prior notice is considered to be necessary. Service upon the opposite parties is thus dispensed with.
Upon perusal of the photocopies of the order passed by the learned court below annexed with the
instant revisional application, it appears that the referred court is under the charge of Presiding Officer, 9th Bench, City Civil Court.
Accordingly, the learned Judge remaining in Charge, XIth Bench, City Civil Court, at Calcutta, is requested to dispose of injunction application expeditiously as possible, subject to his suitability, and convenience, providing sufficient opportunity of hearing to both the parties, but without granting any unnecessary adjournment, unless it is extremely unavoidable.
Petitioner is directed to make communication of this order to the learned court below as well as to the learned advocate appearing in the court below for the opposite parties and opposite parties.
With this observation/direction, the revisional application stands disposed of.
Urgent certified photostat copy of this order, if applied for, be given to the parties as expeditiously as possible on compliance of all necessary formalities. (Subhasis Dasgupta, J.)
