Mr. Pinaki Ranjan Mitra ...for the Petitioner Mr. Arun Kumar Saha ...for the State 22-09-2025 AKG Ct. 15 The petitioners claim ownership over Plot Nos. 661 to 663, situated at Parbatipur, Jagatballavpur, Howrah. It is the grievance of the petitioners that respondent nos. 6 and 7 have deviated from the sanctioned building plan granted by the concerned Panchayat. They further allege that, despite repeated representations, the competent authority has failed to take any action in this regard.

Conversely, the learned advocate appearing on behalf of respondent nos. 6 and 7 has produced the sanctioned plan and submitted that the construction has been carried out in strict conformity with the same. He has also placed before this Court a copy of the plaint in Title Suit No. 661 of 2025, pending before the learned Civil Judge (Junior Division), 7th Court, Howrah, to demonstrate that the said suit was instituted by the petitioners with an identical prayer.

Upon perusal of the plaint and the reliefs sought

therein, it appears that the issues raised before this Court are substantially the same. The petitioners, therefore, cannot be permitted to pursue two parallel proceedings simultaneously.

Accordingly, WPA 4062 of 2025 is dismissed.
