For the Petitioner Mr. Rudradipta Nandy ...For the State Mr. Mazumder, learned advocate appearing for the petitioner submits that the petitioner is an employee of M/s. White Blue Retail Private Limited and he has been falsely implicated. No overt act has been attributed to the petitioner and the allegations levelled against him are in the abstract. In the said conspectus, custodial interrogation of the petitioner is not necessary.

Mr. Nandy, learned advocate for the State opposes the petitioner's prayer and draws our attention to several documents in the case diary. He submits that the petitioner herein is a part of a racket and he was also arrested in connection with a case at Gurgaon. The racket involves crores of rupees and in view thereof, the petitioner is not entitled to

the relief, as prayed for, more so when investigation is still continuing.

Mr. Mazumder, in reply, submits that in the case, as referred to by Mr. Nandy, the petitioner had already been enlarged on bail.

Having heard the learned advocates appearing for the respective parties and considering the materials in the case diary, the gravity of the offence, the nature of allegations and the extent of complicity of the petitioner in the alleged offence, we are not inclined to exercise any discretion in favour of the petitioner and his prayer for anticipatory bail is refused.

The application for anticipatory bail, being CRM No. 1766 of 2021, is, accordingly, dismissed.
