Affidavit-of-service filed in Court today by the Counsel for the petitioner be taken on record. The petitioner's case for eligibility under the Memo of the Government No.9008-F(P) dated 16th September, 2011 was directed to be revisited by a Coordinate Bench of this Court in the order dated 3rd August, 2017 passed in W.P. No. 20250 (W) of 2017. Pursuant to the order, the Special Secretary, Panchayat & Rural Development Department, Government of West Bengal dated 14th September, 2017, sought a report from the District Magistrate, North 24 Parganas as regards the nature of work and background of the petitioner.

It is stated that the Block Development Officer, Barasat-I, North 24 Parganas has communicated to the District Panchayat & Rural Development Officer/District Magistrate, North 24 Parganas the status of the two petitioners indicating that they have

been working as Gram Panchayat Karmees under Chotojagulia Gram Panchayat against the sanction post. Other particulars are also provided.

The petitioner has come to know of the above internal communication recently.

In the above circumstances, the Special Secretary, Panchayat & Rural Development Department, Government of West Bengal/competent authority under his office shall call for specific records from the District Magistrate/District Panchayat & Rural Development Officer at North 24 Parganas and obtain confirmation of the report dated 10th November, 2017 submitted by the Block Development Officer, Barasat-I, North 24 Parganas and pass suitable orders within a period of two months from the date of communication of a copy of this order positively. In view of the above, the instant writ application shall stand disposed of.

There will be no order as to costs.

All parties are directed to act on a server copy of this order on usual undertakings.
