Learned Counsel appearing for the petitioner submits that after successful completion of training qualification, the petitioner made a representation on 5th February, 2020 before the Commissioner of School Education, (Primary Branch), Government of West Bengal being the respondent no.2 in the instant application to grant 'A' category scale of pay for acquiring training qualification, but till date such representation dated 5th February, 2020 has not been considered by the State respondent.

Learned Counsel Mr. Chattopadhyay appears for the State and Mr. Vaisya, learned Counsel appears for the Council.

Heard all the parties.

As the representation dated 5th February, 2020 has not been considered by the Commissioner of School

Education, (Primary Branch), Government of West Bengal, the Commissioner of School Education, (Primary Branch), Government of West Bengal being the respondent no.2 in the instant application is requested to consider the representation of the petitioner. The writ petitioner is directed to serve a copy of this order along with a copy of the writ petition to the Commissioner of School Education, (Primary Branch), Government of West Bengal. The Commissioner of School Education, (Primary Branch), Government of West Bengal is requested to give an opportunity of hearing to the petitioner and to allow the petitioner to produce all the relevant documents at the time of hearing and to pass a reasoned order within twelve weeks from today. The Commissioner of School Education, (Primary Branch), Government of West Bengal is also requested to communicate the reasoned order to the petitioner at an earliest.

The writ petition being WPA 4646 of 2021 is accordingly disposed of.

There will be no order as to costs.

Since no affidavit have been invited, the allegations made in the writ petition are deemed to have been denied.

Urgent certified website copy of this order, if applied for, be made available to the parties upon

compliance with the requisite formalities.
