The petitioner was serving in the West Bengal Police Force. A disciplinary proceeding was initiated against him and he has been dismissed from service. Challenging the order of the disciplinary authority the petitioner has preferred an appeal before the appellate authority being the Inspector General of Police, Barasat on February 25, 2026. The said appeal is pending consideration till date.

It has been submitted by the learned advocates representing both the parties that March 30, 2026 is the date fixed by the appellate authority for hearing the petitioner in connection with the appeal. 3.

As it appears that the order impugned in the writ petition, being the order of the disciplinary authority, is an appealable one and an appeal has been preferred before the competent authority which is pending disposal, accordingly, the instant writ petition stands disposed of by directing the appellate authority to consider and dispose of the appeal preferred by the petitioner in accordance with law at the earliest.

It is made clear that this Court is not entering into the merits of the claim of the petitioner and all points are left open to be decided by the appellate authority at the time of consideration of the appeal. 6.

The prayer of the petitioner for engagement of defence assistant is also pending consideration. The authority shall take a decision on the same in accordance with law.

The writ petition and the connected application both stand disposed of.
